Some forms have changed through the years, but the majority of the language has remained the same. Each transaction is unique, but the following forms are commonly filled out. In addition to these forms, various addenda may be added as the transaction moves towards closing. Brokers may have their own specific forms to be filled out. - Purchase Contract (Purchase Offer) - prepared for the buyer.
- Counter Offer - may be prepared by seller or buyer as part of purchase negotiation.
- Distressed Property Addendum - prepared for buyer and submitted with offer in case a property becomes a distressed property during the transaction (i.e. short sale, foreclosure, etc.).
- As- Is Addendum - prepared for buyer's signature to submit with the offer to let the seller know that buyer will purchase the property without the seller fixing anything. Although included with purchase offer, normally takes effect after the buyer has had the chance to fully inspect the property.
- Lead-base Paint Addendum - prepared for properties built on or before 1978.
- Seller's Real Property Disclosure Statement - prepared by the seller; reviewed by the buyer.
- Listing Contract - agreement between the seller and the listing broker and/or agent. The buyer doesn't see this contract.
